1. Registration:
You can register in writing via letter, fax, or e-mail. Your registration is binding when we confirm the date. Requirement for the participation is, amongst other things, the submission of a limitation of liability statement.
2. Deposit / Payment of balance:
With receipt of the booking confirmation, a down payment of 300 Euro per person is due. The balance is due 3 weeks prior to departure.
3. Service / costs:
The service contained in our prices can be taken from the product descriptions. Should the case occur, that a single room is not provided by the hotel, in spite of our confirmation, we will refund the additional charge paid to us. The quoted prices are valid for 2008.
4. Services:
Changes and deviations of individual services, which become necessary after the contract is concluded, and were not brought about by the organizer against bona fide, are only granted as reasonable for the participant, if the changes and deviations aren’t significant and don’t impact the product’s overall layout. This applies in particular to a required change in the driving route and the available vehicle model or type respectively. Route outlines are not binding, but are to be viewed as an option in the choice of the route. Please keep in mind that vehicle tours are a mobility form, which requires more involvement on your behalf than an ordinary all-inclusive tour. In addition, a lot can’t be predicted and planned. Therefore we’re counting on your understanding in case of possible changes. We explicitly reserve the right to change the brochure specifications. In this case we will inform you ahead of the conclusion of the contract. The event language is German, alternatively – without claim – also English.
5. Hotel and accommodation:
Our hotels and accommodations are all country-specific, and have a good standard. The meals are substantial and typical of their country.
6. Withdrawal:
Up to 40 days before the tour starts (calculated from the entry of the letter of resignation) 30 % of the costs are payable, from the 39th day on before the beginning of the tour 80% of the costs are payable. Should you be able to fill the freed up place otherwise, we will only charge you a processing fee of 80 Euro per person, as well as a rebooking fee for the flight, if applicable. In addition, you are free to provide us with evidence of a lesser damage. Rebooking of dates is only possible with cancellation of the existing contract and subsequent new registration. We recommend travel insurance. In case we have to cancel an event before begin for reasons beyond our control (acts of nature, strikes, catastrophes i.e.), we will fully refund the participant all of the rendered payments. We reserve the right to cancel an event if a minimum of 10 guests don’t participate. In this event, we will inform you immediately and refund the rendered payments. Additional claims do not exist. Should the scout/instructor fall sick during the event, or be involved in an accident, and a replacement can’t fill in, we will discontinue the tour. The participants will be reimbursed for the amount of the remaining days on a pro-rata basis. Additional claims to not exist. (or Additional claims are not recognized.)
7. Liability:
Within the commercial duty to take care, we are liable for the conscientious preparation, the thorough supervision and selection of the service providers, as well as the duly contribution of the agreed service taking the respective local customs into consideration. Our liability is excluded or limited to the same extent as the service providers, on the basis of legal requirements, which are to be applied to the rendered services by the service provider, whose liability is also excluded or limited. Our liability is limited at any rate to three times the amount of the cost, no matter what the reason is.
a) In as much as the damage to the participant was not caused by the organizer in either an intentional or a grossly negligent manner, or
b) In as much as we are responsible for the damage to the participant solely due to the fault of one of the service providers. A liability for delay is excluded.
8. Compliance with regulations:
The participant is responsible for observing the particular traffic and licensing regulations. Every participant drives at their own risk and is liable for damages inflicted on fellow passengers or other road users/motorists and cyclists, within the limits of the legal liability. This also applies if the participant is following the scout. Every participant has to adapt his driving to the principle of his own safety and driving ability.
9. Complaints:
Should you, in spite of the utmost diligence which we spend on the planning and the realization, still have a reason to complain, we ask you to inform us in writing immediately. You can address this either to your scout or to us. In addition, we ask you to assert claims against us in writing within a month after the event is finished. After this deadline, you can only assert your claim, if you were innocently prevented from keeping the deadline.
10. Miscellaneous:
The invalidity of individual regulations of the contract does not result in the invalidity of the entire contract; rather the parties commit themselves to finding an adjustment which is closest to the original version. Jurisdiction for claims against us is Hindelang. As far as the preceding terms and conditions do not regulate all instances, the statutory provisions apply. The participation is only possible if the limitation of liability statement and the vehicle operator agreement respectively, are signed by the participant.
